The guy may be older, but old guys can get chicks too. And we have no one else to compare him to. Thus making him the protagonist. Now if some ruthless old sleaze comes in episode 2 and steals them, that would make this a NTR. (Figuratively speaking)

why are you saying old guy? ntr refers to anything with a protagonist who likes a girl or has the girl already and has her stolen from him…
That depends when considering NTR as a genre. NTR as a genre has to illicit some sort of jealousy from the viewers or at least make them identify with the guy being stolen from in some way. If the guy doing the stealing is young and at least decent looking, it runs the risk of the audience identifying with him instead, making it Netori (which is definitely not Netorare, especially in terms of sexual appeal and fetishes).
Essentially, Netori makes it seem so that you are DOING the stealing rather than you are BEING stolen from. Naturally, many Netorare ragers love Netori, as it is not the immoral act of NTR that they hate, its the fact that they are self-centered hypocrites.
